Services

MEDIATION

Mediation allows parties to discuss their case in a concentrated confidential setting with a mediator who is trained to listen and understand the concerns of the parties. Many courts require parties to attempt mediation prior to trial. Guided by the mediator, the parties are allowed to come to their own decisions in an attempt to resolve the dispute.

ARBITRATION

In arbitration the parties agree to allow a third party to make a decision on the case. The decision is binding on the parties.

PRIVATE JUDGING

Texas law allows for parties to agree to try a case to a retired or former judge who has at least four years of experience on the bench and has substantial experience in the contested area of law. (Section 151.001 of the Texas Civil Practice and Remedies Code). The parties are responsible for the cost of the judge and court reporter. The location of the trial must be outside a courthouse or government building. The decision of the private judge is subject to appeal, just as a courtroom judgment would be. In most cases, Private judging allows parties to avoid the scheduling delays inherent in a busy county court system.
